Terms of Service
1. Introduction
These terms govern your use of metal.club, a platform operated by Bastian Ventures Limited, a company registered in England and Wales (company number 17418518), whose registered office is at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ (“metal.club”, “we”, “us”). By accessing or using the platform in any way, you agree to be bound by these terms. If you do not agree to these terms, you must not use the platform.
2. The Platform
metal.club is a music commerce and community platform connecting metal artists with fans. We facilitate transactions between artists and fans but are not a party to those transactions. Artists are solely responsible for the products they list and their fulfilment obligations.
3. Accounts
You must be 18 years of age or older to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate and complete information when registering and keep it current. We reserve the right to suspend or terminate accounts for violations of these terms.
4. Artists and Labels
Artists and labels must own or hold the necessary rights to all content uploaded to metal.club. All uploads must comply with our AI Music Policy. Artists must complete Stripe Connect onboarding before receiving payouts. Artists are obligated to fulfil physical orders in a timely manner and to a reasonable standard.
Platform fees apply as follows: accounts on the paid tier are charged an 8% platform fee on all sales. Accounts on the free tier are charged 0%. Stripe transaction fees are passed through at cost and are separate from the platform fee. Fee structures may be reviewed and updated with notice to affected users.
5. Purchases and Refunds
When you buy on metal.club, your contract of sale is directly with the artist or label offering the item — the seller of record. metal.club acts only as that seller's agent to process the payment and facilitate the transaction; metal.club is not the seller of any music, merchandise or physical goods, and is not responsible for fulfilment, dispatch, delivery or the condition of physical items. The seller of record is responsible for fulfilling your order and for handling any order, delivery or product enquiry.
Digital purchases are final once the download is made available to you, and you agree at checkout that your right to cancel ends at that point. The seller may still choose to refund a digital purchase, and digital content that is faulty or not as described will be repaired, replaced or refunded as the law requires. Physical product refunds are at the individual seller's discretion, and any refund is issued by the seller of record, not by metal.club. If you believe you have been incorrectly charged, please contact us at legal@metal.club within 14 days of the transaction.
Free copies and download codes. Sometimes a seller gives a record away — a download code with a vinyl purchase, a press copy, a giveaway. Redeeming a code requires an account, confirmation that you are 18 or over, and acceptance of these Terms, just like a purchase. Once redeemed, the record is yours: you get the same ownership and download rights as if you had bought it, the seller of record is the same band or label it would be for a sale, and the grant is final — it cannot be revoked by the seller. A seller may cancel a code you have not yet redeemed.
Pre-orders. When you pre-order, you pay in full at checkout, and the record is yours from the moment it is released — digital downloads unlock on release day, and physical items ship from the date shown on the listing. If the seller cancels the release, you are automatically refunded in full; you do not need to do anything. If the release date moves more than 90 days later than the date shown when you ordered, we will email you a refund offer — your order stands unless you choose to take it. Pressing delays are normal in this world; nothing is ever cancelled automatically because of one.
6. Prohibited Content
The following are not permitted on metal.club:
- AI-generated music in any form
- Content you do not own the rights to
- Content that infringes copyright or other intellectual property rights
- Illegal content of any kind
7. Intellectual Property
Artists retain full ownership and rights to their music and content. By uploading content to metal.club, you grant metal.club a non-exclusive, worldwide licence to display, stream, and promote that content on the platform. This licence terminates when the content is removed or the account is closed.
8. Community Standards
Users must treat others with respect at all times. Spam, harassment, hate speech, and impersonation are strictly prohibited. We reserve the right to remove any content that violates these standards and to suspend or terminate the accounts of users who repeatedly breach them.
9. DMCA and Copyright
We comply with the Digital Millennium Copyright Act (DMCA) and the Copyright, Designs and Patents Act 1988. If you believe content on metal.club infringes your copyright, please report it to legal@metal.club with full details of the alleged infringement.
10. Platform Availability
We aim to maintain high platform availability but do not guarantee uninterrupted access. We are not liable for any losses arising from platform downtime, scheduled maintenance, or circumstances beyond our reasonable control.
11. Limitation of Liability
To the maximum extent permitted by UK law, metal.club is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of revenue, loss of data, or loss of business opportunities.
12. Dispute Resolution
We encourage you to contact us in the first instance to resolve any dispute informally. If a dispute cannot be resolved informally, it will be referred to CEDR arbitration (cedr.com). Nothing in this clause affects your right to bring a claim in the small claims court.
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms are subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these terms from time to time. We will notify registered users by email of any material changes before they take effect. Your continued use of the platform after changes are published constitutes acceptance of the updated terms.
